New sources, and new users that are determined to be significant industrial users (SIUs), shall install and have in operating condition all pollution control equipment required to meet applicable pretreatment standards prior to discharging to the POTW.

Any wastewater discharge permit issued to a categorical user shall not contain a compliance date beyond any deadline date established in EPA’s categorical pretreatment standards. Any other existing user that is considered to be an SIU, or a categorical user that must comply with a more stringent local limit, which is in noncompliance with any local limits may be provided with a compliance schedule to ensure compliance within the shortest time feasible.
