Certain activities set forth in LMC 17.10.044 are exempt from the requirements of this chapter. The director may exempt such activities, as well as others, provided:

A. No person shall conduct any activity within or adjacent to any critical area or critical area buffer that is exempt from the provisions of this chapter until such person has given 10 days’ advance written notice (unless for an emergency per LMC 17.10.044(A)) to the director. The notice shall identify the activity to be conducted and the exemption(s) relied upon by the person who intends to conduct such activity; and

B. Such exemptions shall be verified by the director and acknowledged in a written notice prior to the commencement of the activity; and

C. Identified impacts are avoided to the maximum extent feasible; and

D. Any unavoidable impacts to critical areas and their buffers are minimized; and

E. Impacted areas are immediately restored. (Ord. 3193 § 2, 2016)
