The director has the authority to increase a wetland buffer width up to 50 percent if the wetland contains a threatened or endangered species or the buffer or adjacent uplands has a slope greater than 15 percent or is susceptible to erosion and standard erosion-control measures will not prevent adverse impacts to the wetland and a larger buffer is needed to protect these critical areas.
