Any person convicted of a violation of LMC 10.12.300 or 10.12.600 is guilty of a misdemeanor; provided, however, that violation of LMC 10.12.300(B)(9), when said violation occurs from a stereo or radio in a motor vehicle as defined in this chapter, shall be a Class 1 civil infraction as defined in RCW 7.80.120.
